Terms of Service

These Terms of Service ("Terms") govern your use of the applications, websites, and services published by Blackship Developers and BlackshipDevs ("we," "us," or "our"), including but not limited to Too Hard Pile (toohardpile.com), MemorySpace, Power PDF, and Picto (formerly published as "English Verbs & Forms Offline") (together, the "Services").
By downloading, installing, accessing, or using our Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Services, you confirm that you meet these requirements.
2. License to use the Services
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use our apps on devices you own or control, and to access our web services such as Too Hard Pile, for personal, non-commercial purposes, in accordance with these Terms and (for apps obtained from Google Play) the Google Play Terms of Service. All rights not expressly granted to you are reserved by us.
Where a Service requires an account, you are responsible for keeping your login details secure and for activity that takes place under your account. You must provide accurate information when creating an account, and you may not share an account or use another person's account.
3. Acceptable use
You agree not to:
- Use the Services for any unlawful, harmful, or fraudulent purpose
- Copy, modify, distribute, sell, rent, lease, or sublicense the Services
- Reverse-engineer, decompile, or disassemble the Services, except where permitted by applicable law
- Interfere with, disrupt, or attempt to circumvent security or technical limitations of the Services
- Use automated means to access or misuse the Services
- Remove or alter any copyright, trademark, or other proprietary notices
4. Your content
Documents, memories, forms, and other content you create or store in the Services remain yours. We claim no ownership of your content.
Because our apps store content locally on your device, you are responsible for maintaining backups. We are not liable for loss of data resulting from device loss, damage, uninstallation, or failure to back up.
Where a Service stores your content on our servers so that it is available to you across sessions — for example Too Hard Pile's practice progress and decision journal — we host that content in order to provide the Service to you. It remains yours, we do not sell it, and you may request its deletion as described in our Privacy Policy. We still recommend keeping your own copy of anything you would not want to lose.
You are solely responsible for the content you create, store, or share, and for ensuring it does not violate any law or the rights of others.
5. Intellectual property
The Services, including their design, branding, code, and content (excluding your content), are the property of Blackship Developers and are protected by applicable intellectual-property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
6. Ads, purchases, and subscriptions
Some Services may display advertisements served by third-party partners, including Google AdMob. These partners may use device identifiers and other data to deliver and measure ads in accordance with their own terms and privacy policies. You can learn how we handle advertising, and how to opt out of personalized ads, in our Privacy Policy.
If a Service offers one-time purchases or subscriptions, payment is processed by Google Play Billing, not by us. Subscriptions renew automatically at the then-current price for the selected billing period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel subscriptions at any time in your Google Play account settings. Prices, taxes, free-trial terms, renewals, cancellations, and refunds are handled according to Google Play's policies and any terms disclosed in the app at the point of purchase.
Purchases (such as ad removal or premium features) unlock functionality within the specific app they are made in, are tied to your Google account, and can normally be restored by reinstalling the app with the same account. We may change which features are free or paid in future versions, but features you have already purchased will remain available to you within that app, subject to these Terms and Google Play's policies.
Subscriptions to our web services are handled differently from app purchases. Too Hard Pile subscriptions are processed by third-party payment providers — Creem as merchant of record for international payments, and Razorpay for payments in India — not by Google Play. Prices are shown at the point of purchase and are exclusive of any applicable taxes. Subscriptions renew automatically for the selected billing period at the then-current price unless you cancel before the period ends; you can cancel at any time from your account, and cancellation stops future renewals. Except where a refund is required by applicable law or by the payment provider's own policy, payments already made are non-refundable, and cancelling does not refund the current period. We may change our prices, and any change applies from your next renewal.
The Services may contain links to, or rely on, third-party websites or services that we do not control. We are not responsible for their content, policies, or practices.
7. App stores and Google Play
You obtain our apps through the Google Play Store, and your use is also subject to the Google Play Terms of Service. You agree to comply with all applicable third-party terms when using the Services.
You acknowledge that these Terms are between you and Blackship Developers only, and not with Google. Google is not responsible for the Services or their content. To the extent these Terms provide a license or set rules for use of the apps, Google is a third-party beneficiary of these Terms and may enforce them against you. We, not Google, are solely responsible for the Services and for addressing any claims relating to them, including product-liability, legal, or regulatory claims, and for support and maintenance.
8. Updates, availability, and changes to the Services
We may update, modify, or discontinue any Service, feature, or content at any time, with or without notice. Updates may be required for continued use. We do not guarantee that the Services will always be available, uninterrupted, or error-free, or that they will be compatible with every device.
9. Termination
You may stop using the Services at any time by uninstalling the apps, or, for a web service, by cancelling your subscription and requesting deletion of your account. We may suspend or terminate your access to the Services if you violate these Terms or where required by law. Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law survive termination.
10. Feedback
If you send us suggestions, ideas, or feedback, you agree that we may use them to improve our Services without restriction or obligation to you.
11. No professional advice
The Services and any content they generate are provided for general informational, educational and productivity purposes only and do not constitute legal, financial, investment, medical, or other professional advice. Documents, forms, or outputs created with our apps (including Power PDF) are your responsibility; you should verify their accuracy and consult a qualified professional where appropriate. You are responsible for ensuring that any document you create, sign, or share is valid and legally sufficient for your intended purpose.
This applies with particular force to Too Hard Pile. Its drills, frameworks, Decision Toolbox and journal are educational tools for practising your own thinking. They do not make decisions for you, do not evaluate your specific circumstances, and are not a recommendation to take or avoid any course of action, financial or otherwise. Every decision you make remains yours, and you should seek qualified professional advice where the stakes warrant it.
12. Disclaimer of warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or fit for a particular purpose.
13. Limitation of liability
To the maximum extent permitted by law, Blackship Developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed the greater of the amount you paid us for the relevant Service in the twelve months before the claim, or USD 50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
14. Indemnification
You agree to indemnify and hold harmless Blackship Developers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.
15. Copyright complaints
We respect intellectual-property rights. If you believe content within or generated by the Services infringes your copyright, please contact us at blackshipdevs@gmail.com with a description of the work, the allegedly infringing material, your contact details, and a statement that you have a good-faith belief that the use is unauthorized. We will review and respond to valid notices and may remove infringing content or take other appropriate action.
16. Export controls and sanctions
You agree to comply with all applicable export-control and sanctions laws. You represent that you are not located in a country subject to a comprehensive government embargo, and that you are not on any government list of prohibited or restricted parties. You may not use or export the Services in violation of such laws.
17. Dispute resolution
If you have a concern, please contact us first at blackshipdevs@gmail.com so we can try to resolve it informally. Most concerns can be resolved this way.
If a dispute cannot be resolved informally within 30 days, it will be finally settled by arbitration seated in India and conducted in accordance with the Arbitration and Conciliation Act, 1996, in the English language, unless prohibited by the mandatory law of your country of residence. Where such mandatory local law applies, you retain the right to bring proceedings in the courts of your place of residence. To the extent permitted by law, disputes will be resolved on an individual basis and not as part of a class or representative action.
18. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Where applicable law grants you mandatory consumer protections in your country of residence, those protections remain unaffected.
19. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, power or internet outages, acts of government, labor disputes, or failures of third-party platforms or service providers.
20. Assignment
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms, in whole or in part, to any successor or affiliate, including in connection with a merger, acquisition, or sale of assets.
21. Entire agreement
These Terms, together with our Privacy Policy and any additional terms presented within a specific app, constitute the entire agreement between you and Blackship Developers regarding the Services and supersede any prior agreements on the same subject.
22. Severability and waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later.
23. Changes to these Terms
We may update these Terms from time to time. When we make changes, we will update the "Last modified" date above. For material changes, we will make reasonable efforts to provide notice within the app or on our website. Continued use of the Services after changes are posted means you accept the updated Terms.
